Since 1 January 2026 Catalonia has applied Llei 11/2025: a seasonal tenancy is now defined by its reason — work, study, medical treatment, waiting for a home of your own — rather than by its length, and that reason has to be documented. In Barcelona, which is a stressed-market area, seasonal and room-by-room lettings fall under the same rent cap as ordinary long-term ones. Tourist and holiday lets are outside these rules.
What changed in Catalonia in 2026
The central change is that a seasonal contract has stopped being a way around the rent cap.
Before 2026, a great many Barcelona landlords let on eleven-month "seasonal" contracts for exactly one reason: the price limits did not reach them. Llei 11/2025, de 29 de desembre, de mesures en matèria d'habitatge i urbanisme, published in DOGC no. 9574 on 31 December 2025, closed that route.
The law puts several rules into Catalan housing legislation:
- A seasonal contract is defined by its purpose — work or professional need, study, medical treatment or care, or a temporary situation such as waiting for a new home to be handed over or for your own to be free again.
- The purpose goes in the contract and is evidenced by documents: a letter from an employer, a university enrolment, medical papers. They are filed together with the deposit at the INCASÒL deposit registry.
- The tenant's permanent address goes in the contract — the place where they live most of the time.
- Price, indexation, charges, deposit and guarantees in these contracts follow the rules for ordinary residential lettings.
- Renewal is possible for as long as the reason still exists and is still evidenced. A chain of contracts between the same parties with no new reason becomes an ordinary tenancy.
A second change arrived in the spring. Since 26 March 2026, under Decret llei 3/2026, a rental advertisement must state the maximum price under the cap, the cèdula d'habitabilitat number, the energy certificate, and whether the landlord is a large holder. A reference-price certificate from the state SERPAVI system is attached to the contract. Missing it is a serious infringement: on the scale in Llei 18/2007 the fine runs from €9,001 to €90,000.
Seasonal, tourist, or long term?
A seasonal letting in the new sense is a home for the duration of a specific need. A tourist letting is a holiday. Where a contract is made purely for rest, holiday or leisure, Llei 11/2025 does not apply to it — but the purpose and the tenant's permanent address still have to be written into the contract.

For someone moving to Barcelona to live, the tourist format does not work — both because it does not fit, and because Barcelona is not renewing tourist licences (HUT) after November 2028.
How the Barcelona rent cap works
Barcelona has been a stressed residential market area (zona de mercat residencial tens) since 16 March 2024. For a new contract in such an area the rent is limited by two rules:
- if the flat has been let in the past five years, the new rent cannot exceed the rent under the last contract, plus the permitted indexation;
- if the landlord is a large holder — in Catalonia, five or more properties in stressed-market areas — or the flat has not been let in the past five years, the rent cannot exceed the state reference index (SERPAVI).
Where both rules apply, the lower figure governs.
Since 2026 these limits reach seasonal contracts too. For a room-by-room letting, the sum of all the contracts on one flat cannot exceed the maximum price for the whole flat.
The cap does not apply to social and protected housing or to tourist properties. During 2026 the Catalan government is updating the list of municipalities covered — two resolutions have been published so far, covering 140 and 131 municipalities, and a plan announced in July 2026 would extend the list to 302, though that has not yet been published. Barcelona remains inside the capped area throughout.
What a long-term contract looks like
Long-term residential letting is governed by the state law, the LAU (Ley 29/1994 de Arrendamientos Urbanos).

For seasonal contracts, Llei 11/2025 extended the ordinary residential deposit and guarantee regime, although the INCASÒL website still states the previous basis — two months' rent, pro rata to the term. In practice the deposit plus the additional guarantee comes to between one and three months' rent.
Who pays the agency fee
On a residential letting, the landlord pays for the agency that found and papered the tenancy. Since 2023 this is written into the law directly: the cost of the agency and of drawing up the contract falls on the landlord. If a landlord's agency asks you for a fee for a viewing or for "paperwork", that is contrary to the law.
There is a separate case: where you engage an agent to search on your behalf. That is your instruction, not a service to the landlord. My search service is paid, and I set the terms in writing before any work starts.
What this means if you are moving to Barcelona
There are fewer seasonal flats on the market than there were, and searches take longer. Some landlords have moved to long-term letting, some have sold, and some now only let where the reason is clear and documented — an employment contract, for instance. In practice that means a few things.
- Get the documents ready first. A seasonal contract needs evidence of the reason — an employer's letter, a contract, a school or university enrolment, medical papers — and your permanent address outside Barcelona. The full list is in documents to rent in Barcelona.
- Allow more time. If you are tied to a start date at work or to the school year, begin six to eight weeks ahead.
- Consider a long-term contract. If you are moving for the long run, long-term letting often gives you more choice and protection for up to five years — and you can still leave after six months.
- Read what the contract actually says. The reason, the term, the permanent address, the deposit and the guarantee all have to match reality.

Can I rent a flat in Barcelona for eleven months?

Does the rent cap apply to seasonal lettings in Barcelona?

How much do I have to pay when I move in?

Yes, after six months, on 30 days' written notice to the landlord. The contract may provide for compensation of no more than one month's rent for each year left to run, pro rata for part of a year.
How do I check that the rent being asked is lawful?
The state SERPAVI system shows the reference price, and since 26 March 2026 a certificate from it is attached to the contract, with the maximum price stated in the advertisement itself. The rent under the previous contract is something you can ask the landlord for.
