To rent a flat in Barcelona, a foreigner normally needs a passport, an NIE if they already have one, proof of income or of savings, and — for a seasonal contract — a document establishing the reason for temporary residence. The law does not require an NIE for a tenancy agreement, but landlords ask for one often, and without it connecting utilities is harder. On signing day, budget the first month's rent, the deposit, and possibly an additional guarantee of up to two months' rent.
What documents does a Barcelona landlord want?
The landlord needs to establish two things: who you are, and whether you can pay. The file is therefore identity documents plus evidence of means.

Documents in your own alphabet will probably not be read. Statements and certificates are best held in English or Spanish.
Can you rent in Barcelona without an NIE?
Yes. The tenancy law (LAU) does not require an NIE to sign a contract, and one can be signed on a passport.
In practice, though, it is asked for often: without it the landlord finds you harder to check, and you will find it harder to put electricity, gas and internet in your own name. The landlord has to lodge the deposit with INCASÒL either way.
If you do not have an NIE yet, compensate with a strong file: an employment contract, bank statements, and sometimes several months paid in advance or a bank guarantee. The NIE itself is obtained through the Policía Nacional on form EX-15; the fee under form 790, code 012, for assignment of an NIE is €9.84. I do not run that process myself — a gestoría or a lawyer does, and I coordinate it.
How much do you need to earn?
The law sets no figure; the decision belongs to the landlord, or to an insurer.
In our experience many landlords work to the rent being no more than roughly 30–40% of net income. That is a market convention, not a legal rule. Many Barcelona landlords insure the tenancy against non-payment (seguro de impago), and in that case your income is assessed by the insurer under their own criteria.
If your income comes from abroad, or you are only just starting work in Spain, the landlord will look harder at savings and at the employer. A company letter about a transfer, stating the role and the salary, works considerably better than statements from a foreign bank.
If the income is not enough: guarantor, bank guarantee or extra deposit
There are three ways to strengthen a file, and landlords know all of them.
- A guarantor (avalista). Someone with income in Spain who is liable under the contract alongside you. Rarely available to people arriving from abroad.
- A bank guarantee (aval bancario). The bank blocks a sum in your account and guarantees it to the landlord. You need a Spanish account; the bank charges a fee.
- An additional guarantee in cash. On a long-term contract of up to five years — seven if the landlord is a company — it cannot exceed two months' rent on top of the deposit.
What a seasonal contract needs
Since 1 January 2026 Catalonia has applied Llei 11/2025: a seasonal contract is defined by its reason rather than by its length. The reason — work, study, medical treatment, or waiting for a home of your own — goes into the contract and is evidenced by documents, which the landlord files with the deposit at INCASÒL. Your permanent address goes into the contract as well. If the reason is not evidenced, the contract counts as an ordinary long-term tenancy.
Documents that serve:
- an employer's letter about a secondment or a temporary project, with dates;
- enrolment at a university or school for the period of the contract;
- medical papers relating to treatment in Barcelona;
- a purchase or construction contract for a home you are waiting for.

How much money do you need on the day?
On signing day you normally pay the first month's rent, the deposit, and the additional guarantee if one has been agreed. The landlord's agency fee is, by law, paid by the landlord.

The landlord must lodge the deposit with INCASÒL within two months of signing, and at the end of the tenancy it comes back to you less any evidenced debts and damage. Ask the landlord for confirmation that the deposit has been registered.
Do you have to register at the town hall?
Yes. Registration (empadronament, alta al Padró municipal) is needed for almost everything else: a school place, a health card, many residence procedures.
It is done at an Oficina d'Atenció Ciutadana of the Ajuntament de Barcelona by prior appointment. Same-day appointments are not issued, and the person being registered has to attend.
A non-EU foreigner needs a passport, the form with the address, and a document establishing the right to live there: the tenancy agreement, or the owner's permission. The published processing time is up to three months. If a landlord forbids registration in the contract, treat that as a warning sign.
How to avoid a rental scam
The main rule: pay nothing before you have seen the flat and the owner's documents. The recurring schemes in Barcelona are these.
- An advertisement priced noticeably below the market, with an "owner abroad" who asks you to transfer the deposit so the keys can be sent.
- A request to pay a "reservation" before the viewing, through a money-transfer service.
- An intermediary who cannot show a contract with the owner or a land registry extract (nota simple).
- A contract with no address, no owner's details, or a different name on it.
Check that the person letting to you really is the owner (a nota simple from the Registro de la Propiedad), pay into a bank account in their name, and get the signed contract before any money moves. Since 26 March 2026 the advertisement must state the maximum price under the rent cap, and a SERPAVI certificate is attached to the contract — the absence of either is also a signal.

Frequently asked questions
Can a foreigner without residency rent a flat in Spain?
Yes. A tenancy agreement does not depend on residence status and can be signed on a passport. The landlord will assess income and guarantees, and without Spanish income will more often ask for an additional guarantee.
Do you need a Spanish bank account to rent?
Not by law, but in practice it is close to necessary: it is the convenient way to pay the rent, a bank guarantee cannot be arranged without one, and many landlords want to see payments coming from a Spanish bank.
Can you rent in Barcelona without an employment contract?
Yes, if you evidence income another way: passive income, savings, tax returns. In that case the landlord will more often ask for a bank guarantee, or for an additional cash guarantee within the limits the law allows.
Do you have to pay an agency fee to rent?
If the agency is acting for the landlord, no: by law the cost of the agency and of drawing up the contract falls on the landlord. If you engage an agent to search on your own behalf, you pay for that service under a separate agreement.
